FilmSpark.ai Use Policy

This Acceptable Use Policy (this "Policy") supplements the FilmSpark.AI Terms of Use and applies to all users of the Services. By accessing or using the Services, you agree to comply with this Policy. Capitalized terms not defined here have the meanings given in the Terms of Use.

This Policy replaces the FilmSpark.ai Use Policy and the Generative AI Prohibited Use Policy, each of which is withdrawn as of the date above.

Violations may result in removal of Content, restriction of features, suspension or termination of your Account, and referral to law enforcement, as described in Section 11.

1. Permitted use

FilmSpark is built for storytelling. You may use the Services to:

●      Create original cinematic content, including scenes, scripts, storyboards, performances, voice, music, and effects.

●      Remix, extend, or enhance media assets you own or are licensed to use.

●      Develop and direct synthetic performers and characters to prototype or produce content for entertainment, advertising, education, research, and commercial purposes.

●      Distribute and commercially exploit content you generate, in accordance with the Terms of Use and all applicable intellectual property, publicity, and privacy laws.

Your rights in Outputs, including your ability to transfer and sublicense them, are governed by Section 4.7 of the Terms of Use. Nothing in this Policy limits those rights.

2. Illegal and dangerous activities

You may not use the Services to generate, distribute, or facilitate content that:

2.1 Child safety

●      Relates to child sexual abuse or exploitation in any form.

●      Depicts, promotes, or sexualizes minors.

●      Facilitates child grooming or endangerment.

We report child sexual abuse material to the National Center for Missing and Exploited Children and to law enforcement. There is no artistic, educational, or documentary exception to this Section, and no appeal.

2.2 Violent extremism and terrorism

●      Promotes, glorifies, or facilitates terrorist activities or violent extremism.

●      Provides instructions for creating weapons, explosives, or other instruments of violence.

●      Recruits for or coordinates violent or terrorist organizations.

2.3 Non-consensual intimate content

●      Creates, distributes, or facilitates non-consensual intimate imagery, including synthetic imagery and deepfakes.

●      Depicts identifiable individuals in sexually explicit situations without their consent.

●      Facilitates so-called revenge pornography or similar harmful content.

2.4 Self-harm

●      Facilitates or encourages suicide, self-harm, disordered eating, or other acts of self-destruction.

●      Provides instructions or encouragement for dangerous activities that risk serious physical harm.

2.5 Other illegal activity

●      Facilitates fraud, money laundering, or other financial crimes.

●      Generates counterfeit currency, documents, or credentials.

●      Promotes or facilitates human trafficking, illegal drugs, or other criminal activity.

●      Provides instructions for synthesizing or obtaining illegal substances or strictly regulated goods.

●      Violates export control laws or sanctions regulations, including as described in Section 18.12 of the Terms of Use.

3. Security and system integrity

You may not use the Services to:

3.1 Circumvention and adversarial use

●      Bypass, override, disable, or attempt to circumvent safety filters, guardrails, abuse protections, or content moderation systems, including by prompt injection.

●      Manipulate the models or the Services to produce content that this Policy prohibits.

●      Reverse engineer, decompile, or attempt to derive the underlying models, algorithms, or architecture of the Services.

3.2 Spam, malware, and abuse

●      Generate spam, phishing attempts, or malware, or content designed to compromise accounts or systems.

●      Facilitate identity theft or credential harvesting.

●      Interfere with, disrupt, or abuse our infrastructure or that of any third party, including through automated attacks, denial-of-service attacks, or bot-driven abuse.

3.3 Unauthorized access

●      Gain or attempt to gain unauthorized access to systems, accounts, or data.

●      Bypass authentication, security measures, or access controls.

●      Exploit vulnerabilities in the Services or related systems.

4. Harmful and abusive content

4.1 Hate speech and discrimination

●      Promotes hatred, violence, or discrimination against individuals or groups based on race, ethnicity, national origin, religion, caste, sexual orientation, gender, gender identity, disability, age, or any other protected characteristic.

●      Advocates for or incites violence against protected groups.

●      Promotes or glorifies hate groups or their ideologies.

4.2 Harassment and bullying

●      Harasses, bullies, intimidates, threatens, or abuses individuals.

●      Targets individuals with sustained hostile or degrading content.

●      Facilitates doxing, stalking, or other invasive behavior.

●      Is designed to humiliate or shame specific individuals.

4.3 Violence and gore

●      Depicts or glorifies extreme violence, gore, or suffering outside the exceptions in Section 10.

●      Incites or encourages violence against people or animals.

4.4 Sexually explicit content

●      Creates pornographic or sexually gratifying content as a primary purpose.

●      Generates sexually explicit depictions of identifiable individuals without consent.

●      Facilitates sexual exploitation or sex trafficking, or advertises escort or similar adult services.

5. Deception, misinformation, and provenance

5.1 Provenance

●      Misrepresenting AI-generated content as created solely by a human with intent to deceive.

●      Removing, obscuring, or falsifying attribution, watermarks, content credentials, or provenance metadata applied by the Services.

●      Using Outputs to impersonate real individuals, including public figures and private persons, in a manner intended to deceive.

5.2 Harmful misinformation

You may not generate demonstrably false or misleading content about elections, voting processes, or electoral outcomes; public health crises or medical treatments; natural disasters or emergency situations; or financial markets with intent to manipulate. You may not create disinformation campaigns or propaganda intended to mislead the public.

5.3 Fraudulent use

●      Fake reviews, testimonials, or endorsements.

●      Misleading advertising or deceptive marketing materials.

●      Fabricated credentials, certifications, or official documentation.

●      Content designed to manipulate financial markets or facilitate securities fraud.

5.4 Coordinated inauthentic behavior

●      Fake accounts, personas, or identities used for coordinated inauthentic behavior.

●      Astroturfing, manufactured consensus, or fake grassroots campaigns.

●      Manipulation of online discussions, reviews, or social media engagement, including click farms and engagement pods.

6. Intellectual property, likeness, and privacy

6.1 Intellectual property

●      Generating content that reproduces copyrighted works without authorization.

●      Circumventing technological protection measures or digital rights management.

●      Using Outputs in a manner that infringes, dilutes, or tarnishes a trademark, or that causes confusion about source, sponsorship, or endorsement.

If you believe content on the Services infringes your copyright, see Section 12 of the Terms of Use for our notice procedure and the contact details for our designated Copyright Agent.

6.2 Likeness, voice, and rights of publicity

You are responsible for obtaining all rights, permissions, releases, and consents required for any material you upload that depicts, records, or is used to replicate a real person, including their image, likeness, or voice. You may not:

●      Upload or submit material depicting or recording another person without that person's permission.

●      Generate commercial content featuring identifiable individuals without proper authorization.

●      Use AI-generated likenesses of public figures for unauthorized commercial purposes.

●      Create endorsements or testimonials falsely attributed to real persons.

Some jurisdictions require specific consent before a person's image or voice may be used to create an artificial likeness or replica. You are responsible for determining whether such consent is required and obtaining it.

6.3 Privacy

●      Processing or generating content using personal information without a proper legal basis or authorization.

●      Creating profiles or dossiers on individuals without consent.

●      Facilitating surveillance, tracking, or biometric identification of individuals.

●      Generating content that exposes confidential, proprietary, or sensitive information.

7. Restricted domains

The Services are designed for storytelling and creative production. You may not use them for:

●      High-stakes automated decision-making. Making automated decisions that materially affect individual rights without human supervision, in domains including employment, healthcare, finance, credit, legal, housing, insurance, education, or access to essential services.

●      Political campaigning. Creating synthetic content to support or attack candidates, parties, or ballot measures, or to interfere with democratic processes.

●      Military and weapons development. Generating content for use in weapons systems, targeting, or combat operations.

●      Professional services. Substituting Outputs for licensed professional advice in medicine, law, finance, tax, or mental health. The Services may produce general information on these topics, but Outputs do not constitute professional advice and must not be relied upon as such.

8. Competitive use and model training

You may not use the Services or Outputs to develop, train, fine-tune, evaluate, or improve any competing generative AI model, service, or technology, or systematically extract Outputs to build training datasets. This restriction is set out in Section 4.7 of the Terms of Use, which permits limited internal, non-commercial use.

For the avoidance of doubt, this restriction runs in one direction only. We do not use your Inputs or Outputs to train, fine-tune, evaluate, or improve any model. See Section 4.4 of the Terms of Use.

9. Your responsibilities

You are solely responsible for ensuring that your use of the Services complies with this Policy, the Terms of Use, all applicable laws, and the policies of any third-party platform on which you distribute Outputs.

Disclosure and labelling. You must comply with any applicable legal requirement to disclose or label AI-generated content in the jurisdictions where you publish. Several jurisdictions now impose such requirements for advertising, political content, and synthetic depictions of real people.

Before using the Services for sensitive, high-risk, or novel applications, you should conduct appropriate risk assessments, implement safeguards and human oversight, obtain legal advice as appropriate, and secure necessary permissions and authorizations.

Effect on indemnification. Use of the Services in breach of this Policy is a breach of the Agreement, and Outputs generated or used in breach are excluded from the indemnity in Section 9.2 of the Terms of Use. See Section 9.4 of the Terms of Use.

10. Context and exceptions

Storytelling explores difficult subject matter. We may permit content that would otherwise fall within Sections 4.1, 4.2, or 4.3 where it is clearly intended for artistic, educational, documentary, journalistic, or scientific purposes, or where the public benefit substantially outweighs the potential harm.

In evaluating an exception we consider the context and intent of the generation, its educational or artistic value, the public interest served, and whether appropriate safeguards are in place.

No exception is available under any circumstances for: child sexual abuse material, non-consensual intimate imagery, real-world harassment of identifiable individuals, content designed to interfere with civic processes, or the security and system integrity prohibitions in Section 3.

11. Enforcement

11.1 Detection and review

We use a combination of automated systems and human review to detect activity suggesting misuse of the Services, including attempts to circumvent safety measures. Our review of Content is limited as described in Section 3.2 of the Terms of Use and is subject to the confidentiality obligations in Section 4.8.

11.2 Actions we may take

Depending on the severity and frequency of the violation, we may issue a warning, remove Content, restrict access to features, suspend your Account, terminate your Account and access to all Services, report the violation to law enforcement, or pursue legal remedies.

11.3 Zero tolerance

Violations involving child sexual abuse material, non-consensual intimate imagery, or attacks on critical infrastructure result in immediate permanent termination and a report to law enforcement, without warning and without appeal.

11.4 Repeat infringers

Consistent with Section 12 of the Terms of Use, we maintain and reasonably implement a policy of terminating the accounts of users who repeatedly infringe the copyrights of others. We record valid notices of claimed infringement against the relevant Account. An Account that accumulates three valid notices within a six month period will be terminated. We may terminate sooner in cases of egregious or willful infringement.

11.5 Appeals

If you believe enforcement action was taken in error, you may appeal within thirty (30) days by writing to legal@FilmSpark.ai. Include your account information, the Content or activity at issue, why you believe the action was incorrect, and any supporting documentation. We will review and respond within a reasonable time. Appeals are not available for the violations listed in Section 11.3. Nothing in this Section limits your rights under Section 16 of the Terms of Use.

12. Reporting violations

To report misuse or content that violates this Policy, contact legal@FilmSpark.ai. Please include a description of the violation, the location or identification of the Content, any relevant documentation, and your contact information if you are willing to provide it.

To report content that infringes your copyright, follow the notice procedure in Section 12 of the Terms of Use and send your notice to our designated Copyright Agent.

13. Outputs may be imperfect

Outputs are produced by machine learning models and may be inaccurate, unexpected, or offensive. You are solely responsible for reviewing Outputs and ensuring that any content you publish complies with applicable law and this Policy before distribution. This Section does not limit the warranty disclaimers in Section 10 of the Terms of Use.

14. Changes to this Policy

We may update this Policy to address new risks, technologies, or legal requirements. When we make material changes we will update the date at the top of this Policy and notify users by email or in-product notification as appropriate, and provide a reasonable period for review before the changes take effect, except where an urgent security or legal issue requires immediate action. Your continued use of the Services after an update constitutes acceptance of the revised Policy.

15. Relationship to other agreements

This Policy forms part of the Agreement. In the event of a conflict between this Policy and the Terms of Use, the Terms of Use control. If you have entered into a separate written enterprise agreement with us, that agreement controls over both to the extent of any conflict.
